This Rental Agreement ("Agreement") is made between TextbookSavvy, Inc. ("Company") and the customer ("Renter") and governs the terms and conditions related to the rental of books and related items ("the Book").

By placing a rental order on our website, the Renter agrees to the following terms:

1. Rental Period

The rental period shall begin on the date the Book is marked as "Delivered" by the United States Postal Service ("USPS"), United Parcel Service ("UPS"), FedEx, or Dalsey, Hillblom and Lynn ("DHL"). The Renter agrees to return the Book on or before the end date of the rental period specified at the time of order or by our email order confirmation.

2. Late Fees

If the Renter fails to return the Book by the end of the rental period, a late fee of $1.50 per day will accrue on the Renter's account. These late fees will continue to accumulate daily until the Book is returned or reported as lost. Late fees will be charged to the payment method on file.

3. Loss, Theft, or Complete Demolition

In the event that the Book is lost, stolen, or completely demolished beyond repair, the Renter agrees to pay a reimbursement fee equal to 1.3 times the original rental price. This amount will be charged to the payment method on file.

4. Damage Penalties

• Severe Watermarks, Ink Marks, and Partial Damage: If the Book is returned with significant damages such as severe watermarks, ink stains, or any partial damage that impairs its future usability, the Renter agrees to pay a penalty of 33.3% of the original rental price.
• The determination of "severe damage" will be made at the sole discretion of TextbookSavvy, Inc.

5. Condition of the Book

The Book must be returned in the same condition as when it was rented, with normal wear and tear expected. Any damage beyond normal wear and tear may result in the application of the damage penalties described in Section 4.

6. Payment and Authorization

By signing this Agreement, the Renter authorizes TextbookSavvy, Inc. to charge the payment method on file for any accrued late fees, damage penalties, or reimbursement fees as outlined in this Agreement.

7. Dispute Resolution

In the event of a dispute regarding any charges or terms in this Agreement, the parties agree to resolve the matter through arbitration in accordance with the rules of the American Arbitration Association.

8. Modification of Terms

TextbookSavvy, Inc. reserves the right to modify the terms of this Agreement at any time. Notice of any changes will be posted on the TextbookSavvy, Inc. website, and continued use of the rental service will constitute acceptance of any revised terms.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which TextbookSavvy, Inc. is incorporated, without regard to its conflict of laws provisions.

By checking the box below, the Renter acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Rental Agreement. The Renter also authorizes the charging of any damage penalties, late fees, and reimbursement for losses from the payment method on file by TextbookSavvy, Inc.
